GENERAL BOOKING CONDITIONS

These booking conditions are established at the moment a reservation is placed by the client ("You", "Your group") and accepted by KOA INVESTMENT SRL and the KOA APARTMENTS brand ("We", "Ours").

ACCEPTANCE OF TERMS AND CONDITIONS / RENTAL AGREEMENT

It will be considered that you have confirmed your reservation and accepted these terms and conditions, either 72 hours after we send you the booking confirmation email or when you receive the booking confirmation email or make a full or partial payment of the rental fee, whichever comes first.

BOOKING CONFIRMATION

All booking details are confirmed by us via a booking confirmation email and are considered to have been accepted by you and your party, unless within 24 hours of sending the booking confirmation email, you inform us by email that you wish to modify or cancel the booking agreement.

PRICES

All prices are quoted in RON and, unless otherwise specified, the quoted prices include VAT at the Romanian rate. All prices are based on the prevailing costs at the time of quoting and may be subject to change.

PAYMENT PROCEDURE

When making a reservation, full payment is required to confirm the booking unless otherwise specified. If we do not receive full payment by that time, the booking may be canceled and the initial payment is retained. You will also be responsible for the balance of the total rent and for any other costs involved in attempting to re-rent the property.

PAYMENT METHODS

Payment must be made in RON and must be made without all bank charges, exchange rate variations, and any other deductions. We accept the following payment methods:

Direct bank transfer to the account mentioned in the issued invoice. When making the payment, please add in details the name and number of the invoice received. A copy of the transfer must then be sent to Us.

POS payment for all cards issued under the Visa/Visa Electron/Vpay/Mastercard/Maestro logo, regardless of type: magnetic stripe, contact chip, or contactless. ING POS terminals accept any card payment method, from cards themselves to payment with devices such as watches, bracelets, or mobile phones enrolled in multiple wallet-type applications.

Payment by vacation vouchers for locations where it is specified that it is accepted.

APARTMENT USAGE

It is prohibited to use our apartments for parties or gatherings where the occupants of neighboring apartments might be disturbed. If, upon arrival, it is deemed that you intend to use the apartments for such an event, you may be denied entry. If such an event is discovered after arrival, you will be asked to leave immediately. In such circumstances, we are not obliged to provide or locate alternative accommodation. The refund percentage is at our discretion.

NUMBER OF OCCUPANTS

You are responsible for ensuring that the apartment is not occupied by more people than is mentioned in your booking, which is set at the number of beds in the apartment. We reserve the right to refuse admission to the apartment if we believe that this condition is likely to be violated. In this case, no refund will be made for the funds paid. The apartment cannot be re-rented/leased to another group/party without our written approval.

CHECK-IN AND CHECK-OUT

The rules for check-in and check-out are set by us. All apartments are usually available after 3:00 PM on the day of arrival. All apartments must be vacated by 11 AM on the day of departure, and keys must be placed in the same location from where they were taken. Arrangements can be made for a later check-out, but this is subject to prior arrangement. If there is a delay in vacating the apartment later than the agreed time, a full day's rental fee will be charged.

APARTMENT DAMAGE

You are responsible for taking all reasonable care of the property and its contents. The property and all equipment, utensils, furniture, etc. must be left clean and tidy at the end of the rental period. Except for normal wear and tear, the tenant will be responsible for any damage to the apartment or its contents that occurred due to negligence, intentional damage, or irresponsible behavior of those occupying the apartment or their guests. Such damages must be reported, without delay, to our local representatives. The cost of repair or replacement must be agreed upon and paid to us. You are responsible for ensuring that no person visiting the apartment during your stay will respect our policies.

TERMINATION BY US

We reserve the right to terminate a booking at any time, on grounds of abuse to staff or other persons, mistreatment of the apartment, or criminal activity by those occupying the apartment or their guests.

INJURIES OR LOSSES

We cannot be held liable for bodily injuries, losses, or damage to personal belongings, regardless of the situation in which the property is located. Neither we nor our representatives can be held liable for any circumstances beyond our control, including, but not limited to, mechanical failure, illness, or failure of any public service supply.

ACCESS RIGHTS

Our representatives and subcontractors have the right to access the property at any time, taking into account your comfort, for the purpose of inspecting the property and performing any essential repair or maintenance work.

PETS

Pets are not allowed.

INFORMATION

All information provided by us is given in good faith and is based on information available at that time. All reasonable measures have been taken to ensure the accuracy of any statements made either in writing or otherwise, but we are not responsible for any variation caused.

COMPLAINTS

Any complaints regarding the apartment, its contents, or our staff must be made immediately in writing to us. We will take all reasonable measures to resolve the issue. We will have no liability for any complaint submitted after the end of the rental period.

LITIGATION

In the event of any dispute arising from the accommodation booking with us, the courts of Romania have exclusive jurisdiction over these matters, and Romanian law prevailing at that time applies at those moments.

FORCE MAJEURE

We will not be liable for any delay, loss, damage, or expenses incurred if the booking needs to be modified or canceled or we cannot fulfill our contractual obligations due to events beyond our reasonable control, which include, but are not limited to, events such as war, civil strife, terrorist activity, labor disputes, natural or man-made disaster, fires, floods, and unfavorable weather conditions.

INSURANCE

The cost of renting the apartment does not include any personal insurance coverage. It is recommended that insurance be taken against cancellation. In addition, it is recommended that personal accident and medical insurance also be insured by you.

SMOKING

We have a no-smoking policy. Smoking is not permitted in the apartments or in the internal common areas of the apartment blocks.

INTEREST

Interest on overdue invoices will accrue from the date payment becomes due, from day to day, until the date of payment, at a rate of 0.1% above the base rate in force at that time and will accrue at such a rate, after, as well as before any judgment.

CONFIDENTIALITY AND DATA PROTECTION

We take your privacy and confidentiality seriously. We collect:

(a) information necessary to process your booking;

(b) information derived from "cookies".

We will try to keep the data up-to-date and accurate, but we do not provide any warranty or guarantee and are not responsible in case any data transmission over the internet is not completely accurate or secure.
