GENERAL
These booking conditions are established at the moment a reservation is made by the client ("You", "Your group") and accepted by KOA APARTHOTELS SRL and the KOA APARTMENTS brand ("We", "Ours").
ACCEPTANCE OF TERMS AND CONDITIONS / RENTAL AGREEMENT
It will be considered that you have confirmed your reservation and accepted these terms and conditions, either 72 hours after we send you the booking confirmation email, when you receive the booking confirmation email, or when you make full or partial payment of the rental fee, whichever occurs first.
BOOKING CONFIRMATION
All booking details are confirmed by us via a booking confirmation email and are deemed to have been accepted by you and your party, unless within 24 hours of sending the booking confirmation email, you inform us by email that you wish to modify or cancel the booking agreement.
PRICES
All prices are quoted in RON and, unless otherwise specified, include VAT at the Romanian rate. All prices are based on the prevailing costs at the time of quotation and are subject to change.
PAYMENT PROCEDURE
When making a reservation, full payment is required for confirmation unless otherwise specified. If we do not receive full payment by that time, the reservation may be canceled, and the initial payment retained. You will also be responsible for the balance of the total rent and any other costs involved in attempting to re-rent the property.
PAYMENT METHODS
Payment must be made in RON and must be made without any bank charges, exchange rate variations, and other deductions. We accept the following payment methods:
Direct bank transfer to the account mentioned in the issued invoice. When making the payment, please include the name and number of the invoice received. A copy of the transfer must then be sent to Us.
POS payment for all cards issued under the Visa/Visa Electron/Vpay/Mastercard/Maestro logo, regardless of type: magnetic stripe, contact chip, or contactless. ING POS terminals accept any card payment method, from cards themselves to payment with watch-type devices, bracelets, or mobile phones enrolled in multiple wallet-type applications.
Payment by holiday vouchers for locations where it is specified as accepted.
USE OF APARTMENTS
It is prohibited to use our apartments for parties or gatherings where the occupants of neighboring apartments might be disturbed. If, upon arrival, it is deemed that you intend to use the apartments for such an event, you may be denied entry. If such an event is discovered after arrival, you will be asked to leave immediately. In such circumstances, we are not obliged to provide or locate alternative accommodation. The refund percentage is at our discretion.
NUMBER OF OCCUPANTS
You are responsible for ensuring that the apartment is not occupied by more people than is mentioned in your reservation, which is set at the number of beds in the apartment. We reserve the right to refuse admission to the apartment if we believe this condition is likely to be breached. In this case, no refund of funds paid will be made. The apartment cannot be re-rented/rented to another group/party without our written approval.
CHECK-IN AND CHECK-OUT
The rules for check-in and check-out are set by us. All apartments are usually available after 3:00 PM on the day of arrival. All apartments must be vacated by 11:00 AM on the day of departure, and keys must be placed in the same location from where they were taken. Arrangements for a later check-out can be made, but this is subject to prior arrangement. If there is a delay in vacating the apartment later than the agreed time, a full day's rental fee will be charged.
APARTMENT DAMAGE
You are responsible for taking all reasonable care of the property and its contents. The property and all equipment, utensils, furniture, etc. must be left clean and tidy at the end of the rental period. Except in the case of normal wear and tear, you will be responsible for any damage to the apartment or its contents which has occurred due to negligence, willful damage, or irresponsible behavior by those occupying the apartment or their guests. Such damages must be reported to our local representatives without delay. The cost of repair or replacement must be agreed upon and paid to us. You are responsible for ensuring that no person visiting the apartment during your stay will breach our policies.
TERMINATION BY US
We reserve the right to terminate a reservation at any time on the grounds of abuse to staff or other persons, mistreatment of the apartment, or criminal activity on the part of those occupying the apartment or their guests.
INJURIES OR LOSSES
We cannot be held responsible for any personal injury, loss, or damage to personal items, regardless of the circumstances in which the property is situated. Neither we nor our representatives can be held responsible for any circumstances beyond our control, including, but not limited to, mechanical breakdown, illness, or failure of any public service supply.
RIGHTS OF ACCESS
Our representatives and subcontractors have the right to access the property at any time, with due regard to your convenience, for the purpose of inspection of the property and to carry out any essential repair or maintenance work.
PETS
Pets are not allowed.
INFORMATION
All information provided by us is given in good faith and is based on information available at the time. All reasonable measures have been taken to ensure the accuracy of any statements made either in writing or otherwise, but we are not responsible for any variations caused.
COMPLAINTS
Any complaints regarding the apartment, its contents, or our staff must be made immediately in writing to us. We will take all reasonable measures to resolve the issue. We will have no liability for any complaint submitted after the end of the rental period.
DISPUTES
In the event of any dispute arising from your accommodation booking with us, the courts of Romania will have exclusive jurisdiction over such matters, and Romanian law prevailing at that time will apply at those times.
FORCE MAJEURE
We will not be liable for any delay, loss, damage, or expenses incurred if your booking needs to be altered or canceled or we are unable to fulfill our contractual obligations due to events beyond our reasonable control, which include, but are not limited to, events such as war, civil strife, terrorist activity, labor disputes, natural or man-made disaster, fires, floods, and adverse weather conditions.
INSURANCE
The cost of renting the apartment does not include any personal insurance coverage. It is recommended that insurance is taken out against cancellation. In addition, personal accident and medical insurance are also recommended to be insured by you.
SMOKING
We have a no-smoking policy. Smoking is not permitted in the apartments or in the internal communal areas of the apartment blocks.
INTEREST
Interest on overdue invoices shall accrue from the date when payment becomes due, from day to day, until the date of payment, at a rate of 0.1% above the base rate in force at that time and shall accrue at such a rate before and after any judgment.
PRIVACY AND DATA PROTECTION
We take your privacy and confidentiality seriously. We collect:
(a) information necessary to process your booking;
(b) information derived from "cookies".
We use cookies to monitor the use of the site and related information. We will try to keep the data up to date and accurate, but we do not provide any warranty or guarantee and are not responsible if any data transmission over the internet is not completely accurate or secure. We use your information to help us improve our site and our service, to personalize the types of information you receive from us, as well as for internal statistical, marketing, and administrative reasons. We do not share this information with external parties unless necessary to process your booking. By using this site and providing your information, you agree to use your information as described above. Confirmation of receipt of the booking confirmation email confirms acceptance of these terms and conditions.
